Features of the formation of the bankruptcy estate and the implementation of exclusive rights in the event of insolvency (bankruptcy) of legal entities

Within the framework of this scientific work, the comprehensive study of bankruptcy estate formation and of the exclusive rights exercise in the process of insolvency (bankruptcy) of legal entities was carried out. Also, the were analyzed by the author: the legal issues of insolvency (bankruptcy); the ways of bankruptcy estate constitution; the other ways of exercising the exclusive rights of the debtor and several other issues related to insolvency (bankruptcy). The objectives of this study lay in the considering the concept and the legal nature of exclusive rights types, the bankruptcy estate composition in the process of insolvency (bankruptcy), the identification of the constitution procedure of the bankruptcy estate in the process of insolvency (bankruptcy); identification of the procedure for the formation of the debtor's bankruptcy estate by including exclusive rights; study of the implementation of the debtor's exclusive rights through sale at auction analysis of other forms of exercising the exclusive rights of the debtor. Based on the research findings, the author concluded that: there is a need to improve bankruptcy legislation to expand the conceptual framework used by the legislator, to make amendments and additions to the Federal Law "On Insolvency (Bankruptcy)" N 127 for the purpose of proper legal support for the use of exclusive rights in the bankruptcy estate in case of insolvency (bankruptcy) of a legal entity.
