Differentiation and Individualization of Criminal Liability

In the course of this work, the concepts of differentiation and individualization of criminal liability have been investigated, an attempt has been made to unify the doctrinal approach to the vision of the phenomena under study. To achieve this goal, the concepts of "differentiation of criminal liability" and "individualization of criminal liability" are defined in several aspects: as the principle of criminal law and criminal policy, as the activities of authorized subjects and as a result of such activities. The delineation of these concepts is carried out, the goals and objectives of differentiation and individualization of criminal liability are determined, the grounds on which they occur, the means used by the legislator and the law enforcer in their process are established. Particularly controversial issues in the composition of the studied concepts are also highlighted and discussed in detail.
