Methodology: The study is based on system approach. The analysis of Russian and foreign legislation was fulfilled with implementation of methodology of formal logic. However, researchers combined formal logical analysis of legislative acts with sociology methods. It had permitted to evaluate real efficiency of legal models established by legislator. Application of sociological methodology had afforded to discover breaks in law and to clear correlation between normative regulation and developing social relations.
In process of exploring different models of legal regulation – Russian and foreign ones – a comparative methodology was employed widely. That methodology has significant importance because many issues have transborder essence. The implementation of that methodology has a special meaning for checking various trends of development at the level of national jurisdictions.
A significant role had fulfilled the systems methodology. It had produced an opportunity to ensure multi-sided approach to exploring the issue of legal regulation of information security and to intellectual property.
Empirical base of research: The base of the research. Empirical (information) base of the research includes official editions of normative legal acts of the Russian Federation, systems Garant and ConsultantPlus,sites containing foreign legislation and materials covering judicial practice, foreign periodicals, library funds.
Results of research: On the basis of wide circle of sources were made the fundamental conclusions concerning a necessity of further improvement of legal regulation of social consequences of IT progress, first of all in the spheres of information security, cloud technologies, right of intellectual property.
Within information society it is observed an interest of the society to transparency, as well to information security. A global trend towards open information, towards transparency, predominates. But in certain cases it is necessary to establish restrictions for access to information, because it permits to maintain a balance between public interest and private one.
Ensuring information security may be a reason for restrictions of transparency. Establishing such restrictions of the transparency is connected, first, with content of information influencing upon information security of the subject, and, second, with legally defined special legal status of appropriate information.
In the information society a role of regime of public domain is on the rise. Its mechanism is directed to ensuring control over employing results of intellectual activity came out from the sphere of its using by owner of the right. As a result, regime of public domain may receive a new impulse for development. It may become a special mechanism ensuring social using results of intellectual work - especially if public costs of transferring rights and its protection appear to be too great. Other important direction of development of regime mentioned is securing implementation of results of intellectual activities created with the budget financing.
It is cleared that currently has a place progressive development of cloud technologies caused by a number of privileges of users (physical persons, businessmen, state). At present time issues of legal regulation of social consequences of implementing cloud technologies become the most urgent ones. Recently foreign practice had proposed a number of various models of legal regulation of relations mentioned. For other side, cloud technologies have transborder essence that needs in some common approach towards its regulation.
Modern digital technologies had found its implementation not only in the sphere of alternate forms of protecting violated rights, but also in state judiciary.
Implementing modern telecommunication ways and means had turned to be a reason for a number of alterations affecting procedures of administering justice in state courts.
Level of implementation, recommendations on implementation or outcomes of the implementation of the results. The results of the research may be used by law-makers, by teachers of legal sciences, also for improvement of civil service qualification.
