Функциональный метод в изучении общих положений договорного права Франции, Германии и России в период «долгого XIX века»

The project aims as investigating the relevance of the functional method of comparative law in the domain of modern legal history. As more scholars investigate the legal past from a comparative perspective and a new discipline of comparative legal history seems to rise, it looks appropriate to evaluate the applicability of the basic method of contemporary comparative law on the basis of the positive contract law in France, Germany and Russia during the ‘long 19th century’. The historical and legal sources (legislation, legal literature, decisions of high courts in all three jurisdictions) of the period will be studied mainly through the model cases, as there are understood in the Trento (Common Core) Project. The intended results of the project are the scheme, basic rules and recommendations on the investigation of contract law on the Continent through the functional method.
