The Pledge of Shares in OJSC under the Russian and the English Law: the Comparative Analysis

In this paper the author analizes the problem of taking security over shares in public companies. The aim of this paper is to figure out the main principles that regulate mortgages and charges in Russia and in England. To fulfill such purpose the author answers the following questions: firstly, what is the legal nature of security interest, secondly, what is the legal nature of the rights represented by the share, thirdly, what are the pacularities of taking security over shares in both jurisdictions.
