The Independent Guarantee in Civil Law of Russian Federation

The latest significant changes in the Civil Code of Russian Federation were made just recently, in June, 2015. In particular, the new institute was introduced in Russian civil law. And it is called the independent guarantee. In general, it replaced the bank guarantee but rather it extended its action and gave subjects several new opportunities in the context of fulfillment of the obligations. The purpose of this work is to analyze the independent guarantee as the new institution of Russian civil law and to detect the advantages it brings as well as problems that remained or appeared for the first time and to propose the ways how to solve it out. According to the results of the study the reforf of the Civil Code is evaluated positively , but, nevertheless, there are some problems associated with the independent guarantee . For example, some questions about the form of the guarantee and about its judicial nature need clarification.
