Copyright and Related Rights in Music

Music is an integral part of human life. Today, the development of modern technology and communication tools allows any user to have almost unrestricted access to music. This situation leads to many problems in the field of copyright and related rights. Because of the above, the aim of the research is to study the legal regulation in the sphere of copyright and related rights in Russian Federation. Based on the indicated purpose, we have the following objectives: the definition of "composition"; definition of the objective form of a composition; the identification of the main elements of a musical work; the analysis audio derivatives towards the original; the definition of the content of copyright of a composition; the analysis of legal regulation of relations about the use of composition; the collective management of copyright analysis; the analysis of legal regulation of copyright in the Internet; the analysis of the content of related rights; the review of the main types of related rights and ways to protect them. Based on the current study, we have the following conclusions that legislative regulation of copyright and related rights in Russia are in line with international treaties (Rome Convention, the WIPO Performances and Phonograms Treaty), but the current level of development of information technologies requires updating legislation and improving protection copyright and related rights.
