Legal Adjustment of Cultural Heritage Realty Privatization

Graduate qualification project is devoted to the legal adjustment of cultural heritage realty. The purpose of work is to summarize existing information on the process of privatization of cultural heritage, the analysis of the rules governing this process, search for gaps in the legislation and the proposal of possible changes in legislation. In this work, author examines the provisions of the Civil Code, the Federal Law "On privatization of state and municipal property" and other legislative acts that contain кгдуы of legal regulation of the process. After studying the process of privatization of such kind of realty, author has come over on a number of conclusions. Thus, privatization immovable cultural heritage is the most effective way to preserve them. The status of these objects is not sufficiently well understood. The specificity of these objects is left without proper attention by the legislator. It is also necessary to improve the system of selection of potential buyers of objects of cultural heritage. These objects should be allowed to be privatized only by those, who are capable to provide enforce security commitments, and to ensure access to objects of cultural heritage. It is necessary to conduct counting and registration of existing objects of cultural heritage, to make an inventory and a proper assessment of the value and market price of each of them. It is necessary to harmonize the conflicting norms of different legal acts that make up the foundation of the legal regulation of cultural heritage realty. Thus, privatization of immovable cultural heritage is an effective way for the government and the need for society.
