Supervisory Review as an Extraordinary Stage of the Arbitration Process

Aim: integrated study of Supervisory review as an extraordinary stage of the arbitration process; consideration of issues related to the practice of the revision entered into force court acts. Objectives: to consider the general characteristics of Supervisory review proceedings; to investigate in detail the bases for change or cancellation of a judicial act within the framework of the Supervisory review; to assess the reform of the Supervisory review procedure with a view to ensuring access to justice in the arbitration process; to identify distinctive features of supervision proceedings. The objectives were achieved by examining the doctrinal sources, periodicals, normative legal acts, judicial practice and analysis of statistical data of activities of the higher courts, comparing the obtained indicators. The importance of Supervisory review is the need for the existence of an effective mechanism capable of addressing judicial error after the entry of the judicial act into force or in the process of its execution. The purpose of supervision in Russia is rather redundant in nature, and used only after all existing methods of enforcement in a judicial procedure are exhausted, and in the case that will be committed fundamental error. If the priority objective of the reform of the arbitration process was a unification of legislation, then we can talk about partial achievement. If the legislator wanted to increase the efficiency of the judicial system and to ensure the greatest possible accessibility, analyzing the performance of the judicial statistics, we can conclude that the goal has not been achieved.
