Corporate (Moral Persons) Criminal Liability

Purpose of the real final qualification work consideration of institute of corporate criminal liability. The main objectives of this research are: a) analysis of the bases of involvement of legal entities to criminal liability; b) studying of applicable criminal penalties; c) consideration of functions of corporate criminal liability; d) assessment of foreign model of responsibility of Moral Persons; e) definition of an origin of a design of corporate criminal liability in the European acts, e) the analysis of problems of corporate responsibility; g) assessment of a problem of fault of Moral Persons. On the basis of the conducted research the following conclusions are drawn: first, relevance of this perspective doesn't raise doubts as in modern economic realities the question of corporate criminal liability can't be disregarded as other types of responsibility (civil, administrative) aren't rather effective for protection of the rights and interests of citizens and society against the possible negative consequences resulting from illegal activity of Moral Persons. Secondly, toughening of sanctions of standards of the civil, administrative legislation won't be a sufficient measure for protection of the specified rights and interests. Thirdly, inclusion in the Russian criminal law of Moral Persons as the subject of crimes will cause need for a regulation of features of establishment of category of fault of the Moral Persons, and also the sanctions applied to them, an order of their imposing. The practical importance of work consists in a possibility of use of the received results for further studying of questions of corporate criminal liability and a possibility of her introduction in the Russian Federation.
