Legal Regulation of Work of Athletes

This study is devoted to the peculiarities of legal regulation of work of athletes. The purpose of the study was a comprehensive research of legal regulation of athletes work in Russia and foreign countries, followed by the elaboration of proposals on improvement of the Russian legislation in this sphere. In the study were solved several research problems, in particular: definitions of the concept of the word "athlete" and "professional athlete"; were studied the sources of legal regulation of work of athletes; were identified the features of the employment contract with the athlete; also were considered guarantees and compensations provided to athletes; and were identified the features of legal regulation of female athletes and athletes under the age of eighteen. Special attention was paid to the legal regulation of athletes work in other countries, specifically, were examined American and European professional sports models. As a result of research were developed several proposals. Were given the definitions of the concepts of "professional athlete" and "amateur athlete"; were substantiated the initiative on introduction to Chapter 54.1 of the Labour Code article devoted to features of regulation of Paralympic athletes; was proposed consolidation of the author concept of "sports mode" in Art. 348.2 of the Labour Code and changes in Article 348.4 of the Labour Code governing the temporary transfer of athletes; was substantiated the advisability of introducing common standard contracts for athletes heading for the performance in sports competitions in the national team of the Russian Federation; finally was suggested to introduce a "tentative labor contracts" for athletes passing "viewing" in new sports organization or in sports club.
