Legal Regulation of Strikes in the Russian Federation and Foreign Countries

This graduate paper is aimed at considering the institute of a strike in Russia and foreign countries for creation of a possibility of improvement of labor law.The main objectives of the paper are: (a)studying of the concept of a strike and history of development of the right to a strike in Russia, and also limits of implementation of the right to a strike; (b)studying of the practice of application of the right to a strike and consequences of its application; (c)the analysis of the mechanism of legal regulation and implementation of the right to a strike in foreign countries; (d)a formulation of suggestions for improvement of the Russian legislation.The paper consists of an introduction, three chapters, a conclusion and a bibliography.Chapter I examines the concept of labor disputes and strikes, and the history of regulation of the right to a strike in international law and in other countries.The historical aspect of development of the right to a strike in Russia is considered in Chapter II.The special attention is paid to the problems of application and implementation of the right to strike.Chapter III is devoted to the legal regulation of strikes in foreign countries on the example of Great Britain and Germany, for the purpose of carrying out the comparative analysis and promotion of offers on opportunities of improvement of the Russian legislation.On the basis of the conducted analysis it was concluded that the attempt to adopt foreign experience for the improvement of Russian legislation will not be successful, as in foreign countries there are considerable defects in the mechanism of implementation of the right to a strike.Implementation process of the right to a strike has significant flaws in Russia, as it contains a large number of restrictive procedures and prevents workers to realize their right to strike.In this work a number of the shortcomings existing in labor law of Russia has been revealed and offers on their elimination are formulated.
