Appeal Proceedings in Arbitration Courts of the Russian Federation

The modern tendency of unification the procedural law is more than just a short-time strategy in the Russian Federation. It should be stated with the total confidence that the regulation of the arbitration appeals instance will be among the first institutes that need to be modernized, after what the started process of unification could be continued on a new stage – the stage of a consolidated code creation. The main intention of this research is to study the problems of the appeals instance as a stage of an arbitration procedure in order to educe the essence and significant signs of this institute. The theoretical value of the problem is in the development of the scientific understanding of the character of activity of the arbitration appeals instance. The problems and the ways of solution of the outlined problems could be later developed to the condition, acceptable to modernize the current provisions of an arbitration procedure law. The stated goal of this work should be reached by the answering on the questions of the most important problems of the exploring institute. The question of the borders of the arbitration appeals instance reserves the special part of the work. The foundation of this exploration is provided by the analysis of the modern theoretical approaches of the different explorers of the problem and the approach of the legislator. Finding out the strong and weak points of each opinion is an obligatory step on the road to the aim of modernization the current law and creating the new procedure code.
