Legal Regulation of Employment Relations with Foreign Workers

A.K. Knyazeva Legal Regulation of Employment Relations with Foreign Workers The aim of my research is to determine the legal status of migrant employees. To achieve this main purpose it will be necessary: to provide the definitions of employment according to the Russian legislation, categories of foreign citizens in the Russian Federation,their classification; to specify the peculiarities of the legal status of foreign citizens in labor activity on the territory of the Russian Federation; to reveal legal regulation of an attraction and labor utilization of foreign workforce in the Russian Federation and abroad; to identify the main problems of using foreign labor; to characterize the problem of illegal migration in the Russian Federation; to give a general characteristic of the crimes connected with illegal recruiting. The subject of research is the indigence of ensuring constitutional order of staying on territory of the Russian Federation for foreign citizens and people destitute of citizenship, and statutes of the law and other law – creating instruments related to the legal status of foreign citizens and stateless people in Russia. Russian workers abroad are in a worse position than their colleagues from countries that have ratified such international instruments. Development of labor exchange within the CIS, which is explained by closed historical, cultural and economic ties between the countries, is important for the Russian Federation. For effective addressing issues related to the labor migration in the framework of bilateral cooperation of governments is necessary to entry into the new bilateral contract, and to expand the range of governments for cooperation in the framework of bilateral contracts. In this connection it is useful to analyze the situation with observance of migrant workers’ rights, and the development of solutions to combat the violation of the legitimate rights and interests of data.
