Administrative Dispute as a Subject of Administrative Legal Proceedings

In this paper we consider the definition and maintenance of thе type of legal conflict as an administrative dispute. Moreover, the different classifications of administrative disputes and legal construction are given. The existing doctrinal points of view on the concept of "administrative dispute" are complied. The paper examines in detail the concept of the administrative proceedings, as well as the relation of this definition of the term "administrative justice". It determines the nature and content of the administrative proceedings, as well as the conclusion about the prospects of this institution in Russia. It is an attempt to give our own definition of the terms "administrative proceedings" and "administrative dispute". Particularities of the consideration and resolution of administrative disputes, also the legal basis for the consideration and resolution are analyzed. The attention is focused on the resolution of administrative disputes by means of The Code of Administrative Court Procedure which entered into force. In this paper the jurisprudence on the issue of resolution of administrative disputes by the courts of general jurisdiction and arbitration courts are analyzed. The procedure to resolve administrative disputes under The Code of Administrative Court Procedure and the judicial practice of the Code by the time of writing the work has been investigated. The conclusion is that there are changes in the enforcement of the adoption of the Code of Administrative Court Procedure. An attempt to assess the prospects for further application of the Сode and its role in the settlement of administrative disputes is made.
