The Legal Regulation of the Liability of the Trust Administrator – Professional Securities Market Participants

In the nineties of the last century, a new contract of the securities trust was included to the system of the current legislation in the Russian Federation. Typically, this contract permits a proprietor benefit from his capital by giving it under the trust management to the professional trader. The responsibility of trust administrator is an increasingly important area both in the legal relationship and in the economic relationship. The author investigates the current gaps in the legislation by researching legal acts, analyzing court’s practice, learning the doctrinal interpretations and examining the experience of the United States of America and Europe. The results of this investigation show that the legislation should be clarified.
