Problems of Legal Regulation of Criminal Liability for Fraud in Russia and Abroad

In this work we talked about the problems of legal regulation of criminal liability for fraud in Russia and abroad. The goal of this work was to identify the problems of regulation of criminal liability for fraud in Russia and their comparison with foreign experience. When writing work has been used legislative acts and literature (books and periodicals). In this work we have the basic concepts, such as fraud, theft, deceit and abuse of trust, and reflect fraud. The analysis of the constituent elements of fraud. For the implementation of legislative bases of comparison, we have analyzed the legislation of foreign countries. And conducted the comparison. Given the legal description of fraud under the laws of foreign countries. Covers all types of punishment stipulated by the legislation of the Russian Federation. And for comparison, the penalties under the laws of the Federal Republic of Germany and Sweden. Identified and justified the need for such a large number of compositions of fraud, which is represented in the Criminal Code of the Russian Federation.
