Notion and Classification of Evidence in Civil Process

The present research reveals some crucial aspects connected with electronic evidence in civil process. As it was thought earlier an electronic document could not be a separate source of evidence but only a way of storage electronic data. Nevertheless, there is no clear definition of ‘’electronic document’’ in Russian law. The author of this research suggests that electronic documents should be included in the list of evidence of Civil Procedure Code of Russian Federation to avoid enforcement problems. Then, in this work the admissibility of electronic evidence in other legal system is analyzed. The conclusion about inhering the regulation of some foreign countries, where electronic document are accepted as evidence, is drown. It is vital to identify and analyze the authentication and admissibility issues relative to the electronic data involved in the litigation. Analysis of legal documents illustrates some change should be made in the legal interpretation of using electronic documents as evidence. Particularly, electronic documents should be understood as separate kind of evidence.
