Civil Protection of Entities’ Brand Names

By using the name of actors of civil turnover carry on business, commit legally relevant actions individualize themselves in the market. In order to ensure the legality of actions committed, establish a reliable counterparty, and reduce the risk of invalidity of the concluded contracts, all the subjects of civil turnover are interested in the exact establishing with whom they enter into relationship. The purpose of writing the master's thesis is a comprehensive study of the rights on the brand name, mechanisms and methods of protection of participants of civil turnover from illegal use of brand names, development of proposals on improving current legislation on brand name. As a result of writing this research work the author has drawn a number of conclusions and proposals, including the amendments to the law on state registration of legal entities, in terms of giving additional powers to the registering body for refusal of registration, besides, the own definition of the brand name, recommended for inclusion in the Civil code of the Russian Federation. Brand names of commercial organizations are investigated a little in the legal community that determines the scientific novelty of the topic of the present dissertation research.
