Pretrial Investigation of Criminal Cases about Nonpayment of Salary, Pensions, Scholarships and Other Payments

In the practical activities of law enforcement agencies there has been an increase in the number of applications from employees about the timely non-payment of wages to them, benefits, criminal liability for these actions are stipulated in Art. 145.1 of the Criminal Code. Until 2015, Art. 145.1 of the Criminal Code was practically ineffective, in connection with which, there was no established practice of producing preliminary investigation in this category of criminal cases. In the final qualifying work, an analysis of theoretical studies of practical issues and provisions of the legislation on preliminary investigation, especially on crimes provided for in Art. 145.1 of the Criminal Code. In addition, an analysis of a large number of material of investigative and judicial practice was carried out, a conclusion was drawn on the features of the preliminary investigation under Art. 145.1 of the Criminal Code of the Russian Federation, identified the problems available for practice, and proposed recommendations for their leveling. Within the framework of the stated topic, the issues of prosecutor's supervision, departmental procedural and judicial control, as well as interdepartmental interaction of authorities to identify, suppress crimes under Art. 145.1 of the Criminal Code. The positive experience of Perm region of interaction of authorities in the field of protecting the rights of citizens for timely payment of labor was demonstrated.
