Legal Regulation of Citizens Insolvency (bankruptcy) in Russian Federation

The relevance of the research under consideration is due to the absence in the science of a holistic view of the institution of insolvency (bankruptcy) of a citizens, new to the Russian legislation. In the research the author used the following methods: general scientific dialectical, universal scientific methods (analysis and synthesis, induction and deduction, comparison, abstraction, concrete historical, structural-functional, formal-logical, system-structural), special-legal methods (comparative Legal method of system interpretation, legal modeling method). The conclusions and proposals contained in the final qualifying work supplement and develop such a section of civil law science as general provisions on the recognition of a citizens as insolvent (bankrupt), and have a theoretical and methodological significance for further research in this field. The scientific novelty of the research results lies in the fact that on the basis of the available theoretical positions revealed in the work, a modern civil theory of the institution of insolvency (bankruptcy) of a citizens has been developed, which made it possible to form a comprehensive scientific understanding of it. The fundamentally new approach to understanding the institution of insolvency (bankruptcy) of citizens is substantiated in the work - through the prism of comparative legal research; Terminological and methodological prerequisites for using the categories of "insolvency" and "bankruptcy" in Russian civil law; The grounds for the problematic aspects of the substantive component of the procedures applied in the case of bankruptcy of a citizens are clarified.
