Under market economic conditions and the development of private ownership gaps and inaccuracies in the legal regulation generate the imposition of conflicting judicial acts; great attention is paid to only the practical issues, and to develop a theoretical framework for the improvement of the legislation is ignored. In connection with the circumstances of the topic «Problems of crime qualification and detection under art. 183of the criminal code» is relevant. The problem of a broad interpretation of the rules under Art. 183 of the Criminal Code is the main problem identified during the work on the study, it implies other problems of law enforcement and judicial practice requiring authorization at the legislative level. Among the problems identified during the work on the study are: the problem in determining the object of the crime, the violation by the legislator of the rules for building the criminal law norm, the problem of qualification for the totality of crimes, the problems of conducting separate investigative actions The efficacy of the specific investigation using specific hardware. The work allowed to generalize and extend existing understanding of the studied subject.
