Regulation of the Market of Commercial Papers and Securities in Criminal Law

Nowadays there is a system of articles in the Russian Criminal Code, dedicated to the protection of the market of commercial papers and securities. These articles refer to the group of crimes in the field of economic activities and, therefore, they could be called blanket, tightly connected to the civil law. High level of latency is the distinctive feature of these crimes, too. The current study is aimed to identify the existing shortcomings in the criminal law regulation of the market, to suggest ways of their elimination, of increasing the efficiency of the articles in the Russian Criminal Code. Besides, the aims of this study are to define the features of the market as an object of criminal law protection, to reveal the historical experience of criminal protection in this sphere, to define the role of these crimes in the system of crimes in the field of economic activities. In order to reach the outlined aims, the following goals were accomplished: 1) to give characteristics to the main terms used on the market and in special legislation, name types of commercial papers and market participants, 2) to study the market and his features as an object of criminal law protection, 3) to study the history of emergence and development of the market worldwide and in Russia, 4) to analyse the articles in the Russian Criminal Code, define the elements of the crimes, 5) to point to the existing criticism and to name the suggested ways of improvement, to come up with own ways to eliminate shortcomings, 6) to study the statistics of crimes, justify the existing level of latency. With regard to the goals of the study, the plan of work has been formed, and on its basis the structuring of study on chapters and paragraphs has been made.
