Criminal Aspects of Iatrogenic Crimes

The problems of the iatrogenic crimes are the relevant topic for the research in the legal science today. The number of the medical crimes is constantly increasing. However, the latency of these crimes remains high. The different points of view on the definition of iatrogenic crimes and the gaps in the legislation are considered in this research. The detail description and analysis of the bodies of medical crimes according the Russian Criminal Code are included in the delimitation of the study too. In addition, not only the legal details had been described, but also the scientific assumptions about the differences among “iatrogenic” and “medical mistake”, for example. Author outlined the main problems in theory and in practice. Many views and approaches were represented in the present work. Many articles of the Criminal Code of the Russian Federation, which are devoted to the medical crimes, were analyzed in this work. The present investigation demonstrates, that the iatrogenic criminality has been poorly studied from the theoretical and practical points of view. Consequently this topic is actual for the study.
