Intermediary Contracts in Russian Civil Law

This paper is devoted to the concept of intermediary contracts in Russian civil law. The current research starts with the analyzing of the concept of intermediarity in Russian legislation, forwarding with it comparison with the concept of representation. Than the author looks through the foreign commercial legislation in order to compare with the Russian attitude. After that the author makes an attempt to provide a complete classification of intermediary contracts, including so-called mixed and unnamed contracts. This study advances our understanding of the significant features of the investigated type of contracts and their correlation. Legal regulation is a bit confused in most of the cases. The lack of legal regulation leads to the practical problems. Thus, the author provides an analysis of the judiciary practice and identifies the judge view on definite matters. The author concludes that the sphere of contract relationships needs to be developed on the legislative level, as it contains quite many gaps in legal regulation. Especially, it refers to the dealer and distribution agreements, which are quite wide-spread in the commercial sphere but not named in the civil law.
