The Features of Franchising Contract on Russian Civil Law

The aim of the study is a comprehensive analysis of the characteristics of a franchising agreement (commercial concession) in the context of the relevant civil legislation of the Russian Federation. One of the effective mechanisms that allow the entrepreneur to avoid significant investment to build its own brand, is the mechanism of franchising or a franchise agreement. The rapid development of the legal and economic phenomena due to the specific model of the relationship of the parties, which allows franchisees to avoid significant investment in its own brand, and originally to use proven technology and business, and to the franchisor to promote your own brand without the cost of productive assets, thus opening up new product markets. This system saves costs of each of the parties, but leads to their mutual enrichment. Scientific novelty of research consists in the fact that the author considers the institution of the contract of commercial concession, not only in the statics of existence, but also in the dynamics of its functioning and trends of development of civil legislation and judicial practice.
