The Legal Regime of Trademarks: Competition Between Trademarks and Other Means of Individualization

The present research intends to cover the frameworks of the means of individualization and also the conflicts between legal tools on the market of goods, works and services. The relevance of this project is proved by the fact of existing causes in current practice and the assumption of raising conflicts between different means of individualization, which can be forecasted apparently. The theoretical aim of the conducted research is devoted to examination of the nature of intellectual property rights and the problems that arise when the means of individualization do not distinguish from each other. The overall goal of the present research consists of complex analysis of theoretical, practical, doctrinal bases, coexisting with real challenges, caused by legal precedents, also summarizes immanent reasons which lead to the competition between the means of individualization and provides a guideline for their resolution. Within this broad purpose the following questions will be addressed to: 1. focus on the complex analysis of legal regime of trademarks and the other means of individualization; 2.  the examination of theoretical aspects of means of individualization, their comparison in doctrine and legislation; 3. the comparative analysis of step-by-step procedures, establishing the conflicts between means of individualization; The current research includes the following sections: introduction to the study, two chapters, divided into paragraphs, the conclusion and the bibliography.
