Separatism is an issue that resonates with many countries, especially in Europe. At the current stage the separatism is closely related to two basic principles of international law (national self-determination, territorial integrity) which are considered as contradictable. The Catalonia and Basque Country separatism are examples of the conflict between two principles. The aim of this study is to understand if Basques and Catalans are the subjects of international law and the juridical ability to exercise this right by secession. Then, it is possible to understand the existence of contradiction between two basic maxims of international law, the reasons which can be legally used in the fight for independence. The outcomes of the paper provide us with some criteria in terms of which we can evaluate other cases and also understand the role of international institutions such as the EU in ensuring the homeland security. Key words: Basque Country, Catalonia, Spain, EU, separatism, international law, right to self-determination, territorial integrity.
