Marriage Contract: Regulation of Proprietary and Personal Rights and Duties of Marital Partners

This diploma work is devoted to the analysis of the legal nature of marriage agreement in the Russian Federation. The main goal of it is to realize if it possible and necessary to extend the possible content of marriage contract on the Russian soil. While analyzing the historical evolution of this institute in order to mark its peculiarities, the author focuses on the rather-legal analysis with an eye to bring possible decisions for reforming of the Russian family legislation. The paper provides the finding that social and legal terms require extension of content limitation for marital agreement. The suggestion is to permit including personal rights and duties of the marriage partners only, inter alia make them contingent upon proprietary rights and duties and vice versa. At the same time it is still necessary to prohibit including terms of children, custody of them and any other points related to it in order to save the civilized nature of marriage contract.
