Criminal Liability for the Organization of Financial Pyramids

This work is devoted to criminal responsibility for the organization of financial pyramids. In this paper the problem of qualification of the crime, because this matter has been settled sufficiently. In this regard, the definition of the financial pyramid is given, the methods of combating the financial pyramids in foreign countries, the problems of the criminal legal qualification of the financial pyramids in the Russian Federation are investigated, and gaps and other shortcomings introduced by the Federal Law of March 30, 2016 No. 78- FZ "On Amendments to the Criminal Code of the Russian Federation and Article 151 of the Code of Criminal Procedure of the Russian Federation" of Article 172.2 "Organization of Activities for Raising Money and (or) Other Property" th Code. The paper considers problematic issues related to the implementation of criminal liability for the organization of financial pyramids, which are associated with the introduction of Article 172.2 of the Criminal Code. Highlighted the shortcomings and imperfections of the current version of this article. This study is conducted to examine the problem of the qualification of this crime and on the basis of a theoretical analysis of the article and the practice of prosecuting proposals for improving the current legislation.
