On Remedies Available to a Purchaser in Case of Misrepresentation

Whithin the framework of this master's thesis there was an aim to determine which remedies are available to a purchaser in case of misrepresentation and what legal rules are applicable to them considering the functions of the relevant remedy and kind of an infringed legal interest. The legislation that governs misrepresentation of a purchaser is unsystemized and in some measure contraversial. The stated aim is achived by analysis of the difference between infringement of an agreement and tort under Russian law from the the perspective of legal interest and functions of the applicable remedies. As a result of the research it was concluded that in order to determine applicable remedies and legal rules it is necessary to identify whether posive or negative legal interest was broken. The rules on determination the kind of the broken interest are described in the master's thesis.
