Disposal Transactions in Russian Civil Law

The work is devoted to the problems of the Institute of disposal transactions in Russian civil law. The author examines the issues of legal and political reasonability and appropriateness of the so called Trennungsprinzip and Abstractionsprinzip of disposal transactions. On the basis of the analysis of the Russian legislation and judicial practice, and either of the legislation and judicial practice of foreign countries with the wide use of Russian and foreign civil law doctrine, the author concludes that Trennungsprinzip system has several considerable advantages in comparison with system of solo consensu and also that the system of abstract transfer of right has some advantages in comparison with the causal system.
