Protecting the Rights of Bona Fide Purchaser: Problems of Doctrine and Practice

Final qualification work is devoted to a comprehensive legal analysis of the current problems of protecting the rights of a bona fide purchaser. Recommendations for improving legislation in this area are suggested in the research. The legal status of a bona fide purchaser of property, as well as the protection of his rights, are traditionally one of the most controversial and complex problems in civilization. Today, conscientious acquisition is one of the most problematic civil law institute which needs more thorough legal regulation. The problem of balancing the interests of the owner and a bona fide purchaser in reclaiming property from someone else's illegal possession, the adoption of the majority of court decisions on vindication claims in favor of owners, the presence of a criminal environment caused by insufficient legal regulation of this issue are topical issues of the Russian legal reality. The purpose of the study is to identify the actual doctrinal and law-applicable issues of protecting the rights of a bona fide purchaser, as well as to develop proposals to improve the identified shortcomings of legal regulation in this area.
