Distribution of Family Property under Insolvency (Bankruptcy)

Property relations of spouses are regulated by family and civil legislation, however, if one of them is adjudged as a bankrupt, such relations will fall under the regulation of bankruptcy legislation. Such a variety of legal regulation leads to complexities and problems in law enforcement. Unfortunately, collisions of different branches of law complicate the protection of the rights and interests of spouses, and third parties (creditors) . In the following graduate qualification work the author analyze legislation connected with the distribution of family property in case of insolvency (bankruptcy), as well as judicial practice on the following topic. The author reveals a number of problems related to the formation of the bankruptcy of a citizen-debtor, and the potential possibility of an institution of joint bankruptcy in Russian legislation.
