Subsidiary Responsibility of Controlling Bodies in Bankruptcy Proceedings

The graduate work is devoted to the institute of subsidiary responsibility in bankruptcy proceedings. This institute has special significance in bankruptcy proceedings, because nowadays it is a most frequently used way to satisfy creditors’ requests, if value of debtor’s property is not enough. However, analysis of court practice shows that Russian insolvency legislation has a lot of gaps, vague statements and uncertain rules and because of that norms concerning subsidiary responsibility are ineffective. Last alterations were made in the bankruptcy law In July 2017. In this work they have been analyzed in comparison with the earlier versions and law enforcement. It was identified that the institute has become more regulated, although most problems were not decided. It happens because legal nature of subsidiary responsibility is not defined. It was concluded that subsidiary responsibility is a specific type of civil liability. It has unique features that are needed to be considered.
