Some Aspects of Non-constitutional Limitation of Rights for Non-business Organizations in Russia

The main goal of the final qualifying work are to analyze the system of legal regulation for the first time introduced in the Russian Federation institute - "organization performing the functions of a foreign agent", study law enforcement practices and assess the legality and effectiveness of the institution created. Accordingly, the objectives of this study are to identify the concept and the main features of the institution introduced, analyze the legal regulation, discern the ratability and proportionality of legislative control in the activities of non-profit organizations which, identify of problematic aspects of legislation and law enforcement practice. This work presents Russian monitoring mechanism to follow the activities of non-profit organizations which have the political activity in the Russian Federation and receive financial support from foreign sources. This text also contains generalizing and classifying the same models in the experience of foreign countries. The master's terms contain the geography of distribution and development trends of the institute. Also, they’ve analyzed the approach of international bodies and organizations, general recommendations for improving the legal regulation of the activities of such organizations. The results of the research are identified problems of legal regulation in terms of the name of the institution, the structure of the broad interpretation of the concept of "political activity", the expanded legal status the same organizations. The analysis of Russian law enforcement practice showed an outrage in the actions of public authorities in relation to these organizations, the decline of civil society and institutions of the non-profit segment. The author gives suggestions on the improvement of the legal regulation system according to value of constitutional law and recommendations of international organizations.
