Recognition and Enforcement of Decisions of Foreign Courts in the Russian Federation

With the development of international relations, economic cooperation between states, including trade and civil legal relations between legal entities and citizens, there was a need to resolve disputes with the help of the Institute of judicial protection among representatives of different countries. And there are no difficulties between nationals of the same state, but the problem of recognition and enforcement of foreign judgements in the territory of another sovereign state in practice is face with many barriers. Currently, inter-state relations are increasingly expanding, and in this regard, the number of decisions of foreign courts that come to enforcement in the territory of the Russian Federation is increasing. I have analysed national and international sources of law relevant to the topic of the study. The research of the existing scientific papers and judicial practice has revealed the key points that make it difficult to recognize foreign judgments in Russia. In this regard, this diploma paper proposes ways to overcome existing problems, including on the basis of the experience of foreign countries. The comparative legal analysis of the grounds for refusal to recognize a foreign judgment, which are reflected in domestic legislation and international treaties, is also carried out.
