Circumstantial Evidence in Russian Civil Procedure

Of particular interest for the study is the institution of circumstantial evidence in the civil procedural law of Russia, since this institution is not sufficiently regulated by law, but quite often used by the parties in the proof. At the same time, the views of the courts in the examination of this type of evidence differ, which creates a discrepancy in practice and, therefore, problems in the use of circumstantial evidence. The aim of the work is to study the institution of circumstantial evidence existing in the civil procedural law of the Russian Federation. The work reveals the criteria on the basis of which indirect evidence can be separated from other types of evidence. Thus, analyzed the place of indirect evidence among other types. The specificity of circumstantial evidence of its direct use in practice is also traced, the existing problems in the perception of indirect evidence by courts are established, the features of the evaluation of circumstantial evidence are studied and specific rules of proof are proposed. This work consists of an introduction, the main part, which includes three chapters, conclusion and bibliographic list. The structure of the study is determined by the object, subject, purpose and objectives of the study.
