The author analyzes the problem of differentiation of the right to freedom of religion in Europe and the United States, including the concept and elements of the right to freedom of religion, and the problem of limits of the right to freedom of religion in Europe and the United States. In addition, the author analyzing the specifics of the search for a balance between the interests of a state, religious communities and citizens on the example of the practice of the ECHR with the identification of major trends and regularities.
