Common Shared Property in Russian Law: Conflicts Between the Co-owners and Possible Solutions

The paper identifies and analyzes the main types of conflicts between co-owners in the right of common ownership. The relevance of the work is based on the legislative initiatives relating to the protection of the rights of participants in common ownership ( in particular, the legislative initiative relating to protection from "apartment raiding"). The main part of the work consists of three chapters. The first Chapter is divided into four paragraphs. Each of them is devoted to a specific problem in the relationship of co-owners: conflicts of co-owners associated with the cost of maintenance of common ownership, conflicts related to the acting of a co-owner on a behalf of all in common interest, conflicts on the use of common property and protection of the rights of injured co-owners. In conclusion, it is stated which norms of civil legislation concerning common shared property need to be supplemented, what are the main trends in the development of judicial practice and doctrine on the use of common shared property (in particular, common property of an apartment building), as well as an analysis of the ways available to co-owners of protecting their rights.
