The Novel Political and Legal Aspects of Loans and Factoring Within the Prism of Anglo-American Law

This paper contains investigation of the Federal Law of 26.07.2017 №212-FZ which comes in force on 01.06.2018, in particular changes in the regulation of Chapters 42 and 43 of the Civil Code of Russia. Loan and factoring novels are examined using political and legal methodology. This is due to the fact that the changes are only coming into force, many aspects of the new regulation are contrary to the existing approaches of judicial practice. Consequently, the author tries to discover the positive and negative consequences of the changes, as well as to establish the political and economic reasons that made the legislator to reform the Civil Code of Russia. The changes are compared with the law of the United Kingdom and the United States. This is due to the fact that in these jurisdictions loan and factoring are the most developed both from the point of view of law and from the point of view of the volume of the market. The author comes to the conclusion that the changes are generally positive, settle some existing legal and economic issues, bring Russian law closer to international standards.
