Criteriа of Affiliation for Corporate Law Purposes

The term “affiliation” initially appeared in Russian law in 1990s and has not changed since. Meanwhile, the legislation and doctrine got further for last twenty years. Thus, the fact that the definition of affiliation has not changed since 1990s, nowadays there are some problems with application of this term in court practice. The purpose of this paper is to determine criterions for affiliation with respect to comprehend corporate legislation and doctrine. In present worked I have analyzed Russian approach to affiliation as well as approach in foreign legal systems (both common and civil law). I also propose my own approach to criterions of affiliation.
