Temporary Agency Work, or the Employment of Workers Under the Contract on the Provision of Personnel: International-Legal, Foreign and National Aspects

The major problems of the current study are the exploration of the effectiveness of the temporary agency work and the labor of employees under the contract for the provision of personnel as forms of unsustainable employment at the international, foreign and national levels, as well as the identification of major gaps and problems in the process of an application of these forms. It should be noted at the outset that it is attempted to provide: structured description of the legal concept of the temporary agency work and the employment of workers under the contract of the provision of personnel, comparative analysis of these forms’ legal regulation with the foreign jurisdictions, declaration of the institutional validity of these forms of the unsustainable employment and their practical advantages and disadvantages. The proposed research project hypothesizes are the following: the labor of employees under a contract of the provision of personnel (not prohibited by the legislation of the Russian Federation) has the similar features with the temporary agency work, which in Russia is prohibited. In this case, it is necessary to understand whether the temporary agency work is indeed prohibited in Russia. Taking into account the study of the practice of applying temporary agency work abroad, there is a need to apply the international experience to Russian realities. The research paper is divided into three chapters.
