Feature of the Status of the Advocate by the Legislation of the Russian Federation

The Bar Association is the only institution of civil society directly specified in the current legislation of the Russian Federation. Being a guarantee of observing the constitutional right of citizens to qualified legal assistance and access to justice, a developed and independent advocate community, thus, is one of the signs of the rule of law. Therefore, how the status of a lawyer is regulated as a participant in this professional community, then what rights and duties he is entitled to and how these rights are observed shows the true approach of the state to observing its constitutional obligation to ensure the citizens' right to legal assistance. The purpose of this work is to study the legal status of a lawyer in the Russian Federation, his rights, guarantees and duties, identify problems of legal regulation, and also search for possible solutions to them.
