Legal Regulation of Surrogate Agreement

The surrogacy contract is a new, it is not regulated at the legislative level absolutely. We have studied this contract and we came to some conclusions. The legislator does not fix the notions of "surrogacy" and "surrogacy contract". We analyzes the different points of view of scientists on the legal nature of the contract of surrogacy, formulated the concept of surrogacy contract, the contract is considered legal regulation of surrogacy. The consolidation of these concepts will avoid misunderstanding and arbitrary interpretation of this legal institution In our opinion, it is necessary to single out this agreement in a separate federal law.
