Compulsory Licensing of Pharmaceuticals

The present research is devoted to the legal analysis of the compulsory licensing as a tool providing opportunity to manufacture certain products bypassing the patent monopoly under the special circumstances. The analysis of the above-mentioned mechanism is limited to the pharmaceutical sphere of application. The compulsory licensing is a widely discussed topic in the healthcare industry due to the ambiguous opinions about it. The author particularly describes the terms, features and characteristics of the compulsory licensing, comparing Russian, international and some specific foreign legislation systems. Additionally, the paper comprehensively systemizes different types of compulsory licensing, analyzing its main features.
