At present, due to the constant reform of Russian civil and arbitration procedural legislation, as well as due to untimely and inadequate modification of its separate provisions, an advocate-representative in court faces with many difficulties and conflicts in the process of exercising his powers, rights and duties. In particular, there are many practical issues related to the compensation of expenses for the services of an advocate, the obligatory participation of an advocate in the civil and arbitral proceedings, the restriction of the circle of persons who have the right to provide legal assistance, the realization of the advocate's right to request information necessary from the authorities. In essence, the advocate's work today is connected with many risks, which he, on the one hand, takes on the law, and, on the other hand, their reduction does not always depend on the level of professionalism and quality of the advocate's activity. This work is devoted to the legal analysis of these and other problems, focused on developing specific proposals for improving legislation on the legal status of an advocate in the civil and arbitration process.
