Constitutional Guarantees of the Rights of Owners Turning to the Income of the State of Property Obtained by Crime

The present research is devoted to system analysis of the Institute of loss of values or crime profits in favour of the State. Since this is a new legal institution within domestic jurisdictions, special consideration is required. The author alleges that the institute is fully consistent with the requirements of international law. According to the legal essence of research, the full guarantee the constitutional rights of citizens of transfer the property acquired to the State treasury are virtually inexistent. The work revealed that the legislation regulates the procedures of loss of values or crime profits in favour of the State in various ways.
