The Contract of Financial Lease in the Russian Federation

The present dissertation research is devoted to the analysis of the contract of Financial Lease. The history of the formation and development of the concept of a financial leasing contract is traced in the work. The author pays special attention to discussion questions about the legal nature of the financial leasing contract concerning the ratio of the financial leasing contract to other civil law contracts, such as the lease agreement and the sales contract, as well as the number of parties to the contract in question, in particular the special legal position of the seller as a participant in leasing legal relations. Also, the author's attention is drawn to the identification of the problems of the legal regulation of the financial leasing contract in the concept of the development of the civil legislation of Russia, since at present the financial leasing contract is at the stage of its fundamental formation and the issuing of author's proposals for their solution by improving the current legislation. The object of the research is public relations, which are formed during the transfer of property into temporary possession and use under a financial lease agreement. The subject of the study is the norms of Russian legislation, Russian law enforcement practice and legal doctrine in the sphere of regulation of leasing legal relations.
