Legal Regulation of Surrogacy Motherhood in the Russian Federation

This study is an attempt to highlight some of the pressing problems related to the sphere of assisted reproductive technologies - surrogate motherhood. The theme of surrogate motherhood has not been overlooked in the legal literature, however the analyzed sphere does not lose its relevance, since it is aimed at the development of one of the most important directions of the state social policy - infertility treatment. Obviously, the legal regulation of the surrogate motherhood institution in Russia today is at an insufficient level, which gives rise to a number of problems and blank spots. The work examines Russian legislation in the field of surrogate motherhood, law enforcement practice, judicial practice of foreign countries, the position of scientists on this phenomenon and the problems arising in connection with the birth of a child by a surrogate mother. Analyzing the current regulatory legal acts, the author came to the conclusion that it is necessary to develop legislation in this area for the most complete and comprehensive protection of the rights and legitimate interests of the parties involved, in connection with which, proposals were proposed to improve the legal framework.
